CareerCloud SA is a technology platform. We do not act as an employer, recruitment agency, or employment adviser. We do not guarantee that any Candidate will be hired or that any vacancy will be filled.
5. Accounts and Eligibility
You must be at least 18 years old and legally able to enter into contracts to use the Platform. Each email address may only be associated with one account. You agree to provide accurate, complete, and current information and to keep it updated.
You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately if you suspect unauthorised access.
6. Candidate Obligations
When using the Platform as a Candidate, you agree that:
- Your profile, CV, applications, and any other information you submit are truthful, accurate, and not misleading.
- You will not include unnecessary sensitive personal information such as identity numbers, health information, religious beliefs, or trade union membership unless strictly required for a lawful purpose.
- Before providing a referee’s contact details, you have obtained their consent and informed them of the purpose.
- You will only apply for jobs you genuinely intend to pursue and will not spam employers or Recruiters.
7. Recruiter Obligations
When using the Platform as a Recruiter, you agree that:
- All jobs are accurate, lawful, and describe genuine vacancies.
- You will comply with South African labour, employment equity, and anti-discrimination laws.
- You will handle Candidate personal information in accordance with POPIA and our Privacy Policy, and only use it for recruitment purposes.
- You will not post false, deceptive, or fraudulent jobs, and you will remove filled vacancies promptly.
8. Acceptable Use
You may not use the Platform to:
- Violate any applicable law, including POPIA, ECTA, and the Consumer Protection Act.
- Scrape, crawl, data-mine, or otherwise harvest Content without permission.
- Upload viruses, malware, or other harmful code, or interfere with the Platform’s security.
- Impersonate any person or misrepresent your affiliation with any organisation.
- Send unsolicited commercial communications, spam, or harassment.
- Reverse-engineer, decompile, or attempt to discover the source code of the Platform.
We may suspend or terminate your account if we reasonably believe you have breached these rules.
9. Content and Intellectual Property
You retain ownership of Content you submit. By submitting Content, you grant CareerCloud SA a non-exclusive, royalty-free, worldwide licence to use, display, reproduce, and distribute that Content on the Platform for the purpose of operating and promoting the services.
All Platform branding, software, designs, text, graphics, and underlying technology are owned by or licensed to CareerCloud SA and are protected by copyright and other intellectual property laws. You may not copy or reuse them without our written consent.
10. Payments and the Pro Plan
The Pro Plan is a once-off payment of R99 that unlocks unlimited job applications. Payments are processed securely by Paystack. CareerCloud SA does not store full card or banking details.
All prices are quoted in South African Rand (ZAR) and include VAT where applicable. You are responsible for any data or transaction charges imposed by your bank or payment provider.
Because the Pro Plan is a once-off digital upgrade that is activated immediately, refunds are only provided where required by law or at our sole discretion.
The Pro Plan is personal to the account holder who completed the payment. It may not be shared, transferred, resold, or used to provide access to any other person, account, or organisation. We reserve the right to limit, suspend, downgrade, or terminate any account found to be sharing, reselling, or otherwise misusing Pro Plan benefits without refund.
11. Consequences of Sharing the Pro Plan
If we reasonably determine that a Pro Plan has been shared, resold, or used by anyone other than the registered account holder, we may, without prior notice:
- Downgrade the account to the Free plan;
- Suspend or permanently terminate the account and access to the Platform;
- Block the associated email address from future Pro Plan purchases; and
- Pursue recovery of any fees or losses caused by the misuse.
No refund will be given if an account is downgraded or terminated for sharing the Pro Plan.
12. Cancellations, Cooling-Off and Refunds
Before completing any purchase, you have the opportunity to review your order. ECTA grants consumers a cooling-off right in certain electronic transactions. Because the Pro Plan is delivered and activated instantly, your statutory cooling-off right may be limited once performance has begun with your consent.
If you believe you are entitled to a refund or cancellation, contact us at legal@careercloud.co.za within 14 days of purchase. We will respond in accordance with applicable law.
13. Disclaimers
The Platform is provided on an “as is” and “as available” basis. CareerCloud SA does not warrant that the Platform will be uninterrupted, error-free, secure, or that any job, application, or CV will result in employment.
We are not responsible for the accuracy of Content posted by Users, including jobs, company information, or candidate profiles. Use the information at your own risk and verify details directly with the relevant party.
14. Limitation of Liability
To the fullest extent permitted by South African law, CareerCloud SA, its directors, employees, and agents will not be liable for any indirect, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Platform.
Our total aggregate liability for any claim arising from these Terms is limited to the amount you paid to us in the 12 months preceding the claim, or R1,000, whichever is higher.
15. Indemnity
You agree to indemnify and hold harmless CareerCloud SA from any claim, loss, liability, damage, or expense (including reasonable legal costs) arising from your breach of these Terms, your Content, or your misuse of the Platform.
16. Termination and Suspension
We may suspend, restrict, or terminate your account and access to the Platform at any time, with or without notice, if you breach these Terms, if required by law, or if we discontinue the service.
You may delete your account at any time through the settings page or by contacting us. Certain provisions of these Terms will survive termination, including those relating to intellectual property, liability, and indemnity.
17. Third-Party Services and Links
The Platform uses Paystack for payment processing and may include links to third-party websites. We are not responsible for the content, practices, or policies of any third party. Use of third-party services is subject to their own terms.
18. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Platform will first be attempted to be resolved through good-faith negotiation. If unresolved, you consent to the jurisdiction of the courts of South Africa, with Johannesburg as the agreed venue.
19. Changes to These Terms
We may revise these Terms from time to time. The latest version will be posted on this page with an updated “Last updated” date. Material changes will be communicated through the Platform or by email where appropriate.
20. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
